When the term “Vendor” is used, it applies to all Vendors, Exhibitors, and Sponsors. In consideration for being allowed to be a Vendor at the Festival, Vendor waives, releases, and forever discharges the Chennault Fest, its sponsors, producers, officers, directors, agents, insurers, employees, insurers, employees, staff, officials, contractors, vendors, organizers, performers, volunteers, attendees, all other persons or entities involved with the festival, specifically including General Claire L Chennault Foundation, Chennault Aviation & Military Museum of Louisiana, Inc., from any and all claims, causes of action, damages, losses (economic and non-economic), and liabilities of every kind (collectively “Claims”), including, but not limited to, releasing all of the above Released Parties from claims stemming from the Released Parties own negligence, for death, personal injury, or property damage, which may arise out of, result from, or relate to the Vendor’s assistance/participation in, or traveling to or from, the Festival, including, but not limited to, any Claims for theft, damage to any equipment, negligence, partial or permanent disability, Claims relating to the provision of first aid, medical care, medical treatment, or medical decisions (at the Festival site or elsewhere), and any Claims for medical or hospital expenses. Vendor assumes all responsibility for any and all risk of physical injury or death or property damage that it may sustain while participating in anyway, including travel enroute to and from the Festival, in any voluntary e ort or activity of any nature, including the use of equipment and facilities of Chennault Fest. Furthermore, Vendor agrees to indemnify and hold harmless and defend the additional named insureds, including the The City of Monroe, Friends of the Chennault Aviation & Military Museum of Louisiana, Inc, General Claire L Chennault Foundation all of their officers, directors, agents, employees, and volunteers, from any and all expenses incurred, claims made, or liabilities assessed against them, including but not limited to, attorneys’ fees and litigation expenses, arising out of or resulting from, directly or indirectly, in whole or in part, any breach or failure to abide by any part of this Agreement, any of Vendor ’s alleged actions or inactions which cause injury, death or damage to any other person or property arising from any connection or nexus to Vendor attractions or operations. Vendor agrees that the venue and jurisdiction for any action stemming from this agreement will only be in Ouachita Parish, Louisiana and this Agreement shall be governed by the laws of the State of Louisiana. Also, if any provision of this Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions. The Chennault Fest follows updated CDC Health Guidelines. As such, you are required to follow venue rules and guidelines when attending the event. You may be denied entry, removed from the venue, or relocated without prior notice if staff deem you to be unsafe or high risk to any guest or team members.
Vendors will be assigned a setup time for November 7and must be present both days of the Festival.
No water or electricity will be provided. All vendors must be self-sufficient. Menus must be fast service to accommodate a large crowd. If you arrive without the requirements listed in this document, you will not be allowed to vend.
